INTRODUCTION

Your privacy is important to KAM.  This Privacy Policy explains the types of information we collect, and how we collect, use, disclose, share and protect your information.  Please familiarize yourself with our privacy practices and contact us as described below under “Contacting KAM” if you have any questions.

This Privacy Policy applies only to the collection, use and disclosure of information that we may receive through your use of: (i) “Apps,” which means our apps for mobile devices and the internet and (ii) our web domains, including www.kodanshacomics.com, and subdomains (our “Sites”).  We refer to the Apps and the Sites as our “Services”.  

This Privacy Policy does not apply to third-party websites or services that display KAM content, which may include Apple iBooks, Comixology, Google Books and Madefire.  If you view or use any of these other websites or online services, please note that any information you may provide will be subject to the privacy policy and other terms and conditions of those websites or services, and not to this Privacy Policy.

As used in this Privacy Policy, “KAM”, “we”, “us”, or “our” refer to Kodansha Advanced Media LLC.  This Privacy Policy does not apply to our parent company, Kodansha Ltd., or any of the other companies within the Kodansha corporate group such as Kodansha USA Publishing, LLC and Kodansha USA, Inc.

I.    INFORMATION WE COLLECT

We may collect through the Services both personal information that identifies you and can be used to contact you, and non-personal information, which is data in a form that does not allow direct association with you.  Non-personal information includes the IP address through which you are accessing the Services and the unique mobile device ID or virtual unique device identifier for any mobile device you may be using as well as other technical information.

A.    Personal Information

Personal information may include, but is not limited to, your name, e-mail address, date of birth, and any personal photo or image representation. We will collect, use and disclose personal information only as described in this Privacy Policy.

Please note that some non-personal information would be considered a part of your personal information if it were combined with other information in a way that enables you to be identified, but the same information is considered non-personal information when taken alone or combined only with other non-personal information.

B.    Non-Personal Information

Non-personal information, alone, cannot be used to identify or contact you.  KAM collects non-personal information about your use of Apps and includes aggregated information regarding usage of the Services.  The non-personal information collected may include information related to your mobile device, including device type, IP address, unique mobile device ID or other device identifiers, Media Access Control (MAC) address and country of registration (together, “Device Information”).  It may also include time and date stamp, clickstream data, feature usage, time spent viewing KAM content and other statistics.

In addition to the above, non-personal information collected by the Sites may include information relating to your computer, if applicable, and browser type, language, Internet Service Provider (ISP), referring and exit pages, time spent and information searched for.

Subject to applicable law, non-personal information may be used and shared by KAM in its discretion, and is not restricted by this Privacy Policy.

II.    HOW WE USE YOUR INFORMATION

Generally, we use your information to provide you with an efficient and customized experience.  For example, we may use information in the following ways:

  • To send important notices, such as communications about any purchases you may make and changes to our Terms of Use and this Privacy Policy;
  • To allow you to access any content you may have purchased.
  • To promote KAM and Kodansha products;
  • To send “push” notifications to your mobile device regarding Apps that you have used (for example, suggesting that you open the Apps to take certain actions);
  • To allow us to enable you to reset your password if you have forgotten it;
  • To provide technical support and respond to inquiries from you;
  • To prevent fraud and potentially illegal activities and enforce our Terms of Use;
  • To help us to develop, deliver and improve the Services;
  • For market research purposes that support our efforts to deliver a more valuable service to the KAM user community; 
  • To deliver and target advertising from third parties;
  • To gather demographic information about KAM users in order to more effectively manage the Services and provide targeted advertising; and
  • To track clicks or other ad fulfillment metrics.

If we send e-mail or SMS messages to you for the purpose of promoting KAM or Kodansha products or services, or those of a third-party partner, we will generally provide you with choices about receiving further such promotional messages.  Preferences for “push” notifications may in most cases be adjusted through Apps or your mobile device.

III.    HOW WE COLLECT INFORMATION

A.    Generally.

You may be required to enter your name and e-mail address to make purchases through our Apps or Sites.

We may offer you the opportunity to provide us with your e-mail address so that we may send our periodic newsletter to you or provide you with special offers from KAM or our partner companies.  Your e-mail address may also be used as your user name for certain Apps.

We may provide you the opportunity to participate in sweepstakes or contests (“Promotions”), and we may ask you to complete surveys.  If you choose to participate in a Promotion or respond to a survey, we may request that you provide us with personal information such as your e-mail address or mailing address.  Any information collected through a Promotion or survey will be subject to this Privacy Policy unless stated otherwise, for example in the official rules of the Promotion or in a separate privacy policy for the Promotion.

Third-party websites and services displaying KAM content, such as Madefire, may share with us personal information that they have collected.

If you request support relating to an App, we may request personal information such as your name and e-mail address, if that appears necessary to resolving the problem.

Your IP address or Device Information may allow us to determine your approximate geographic location (however, KAM does not access or use exact location information that may be transmitted by your mobile device).

We may also request or receive personal information in other interactions you may have with KAM.  Unless otherwise specified in connection with that request or interaction, any such personal information will be subject to this Privacy Policy.

B.    Cookies and Other Technologies

A cookie is a small string of text that we, or service providers acting on our behalf, such as Google Analytics or other analytics services, send to your computer’s or mobile device’s browser.  Other types of cookies exist, but the cookies in the Services are only used to obtain browser or device-specific information.

Some cookies are necessary to enable an App to function properly and to allow your experience to continue from one session another.  Other cookies can show, for instance, which parts of Apps are the most popular, how much time users are spending there, and how they are interacting with the content.  Cookies planted by KAM do not collect information from your computer or mobile device that is not related to the Service.

You may have the option to disable cookies by changing the options in your browser to stop accepting cookies or to prompt you before accepting a cookie from the pages you visit.  Additionally, you can disable or delete similar data used by browser add-ons, such as Flash cookies, by changing the add-on's settings or visiting the website of its manufacturer.  If you do not accept cookies, however, you may not be able to use all portions of our Services.

We may also use “pixel tags,” “web beacons,” “clear GIFs” or similar means (individually or collectively “Pixel Tags”) in connection with our Services and to collect usage, demographic and geographical location data.  A Pixel Tag is an electronic image, often a single pixel that is ordinarily not visible to users and may be associated with cookies on a user’s device or hard drive.  Pixel Tags allow us to count users who have visited certain pages of the Services and to help determine the effectiveness of promotional or advertising campaigns.

Please note that third parties delivering advertisements through the Services may also use cookies or other technologies.  Their placement and use of cookies and other technologies will be subject to their own privacy policies and terms and conditions.

BY CLICKING ON THE “SIGN UP” BUTTON, WHERE APPLICABLE, OR OTHERWISE BY ACCESSING OR USING OUR SERVICES YOU ARE CONSENTING TO THE USE OF COOKIES AND OTHER TRACKING TECHNOLOGIES ON YOUR DEVICE.  

IV.    HOW WE SHARE YOUR INFORMATION

A.    With Affiliates

We may share your personal information with other companies within our corporate group, including Kodansha Ltd, Kodansha USA Publishing, LLC and Kodansha USA, Inc.  In that case, these companies will be subject to the terms of this Privacy Policy regarding the personal information we provide to them.

B.    With Third-Party Advertising Companies

We will not share your personal information with third-party advertisers, advertising networks and advertising platforms (“Advertising Companies”) for their direct marketing purposes unless you provide your consent.

We may share certain non-personal information with Advertising Companies to develop and deliver targeted advertising in the Services and on the websites and applications of third parties.  We may also allow Advertising Companies to collect non-personal information within the Services which they may share with us, including your device location and Device Information.  Advertising Companies may also collect non-personal information related to the performance of the advertisements, such as how many times an advertisement is shown, how long an advertisement is viewed, and any click-throughs of an advertisement.  Advertising Companies may collect this information through the use of tracking technologies like browser cookies and web beacons.

Although KAM does not provide personal information to Advertising Companies, please note that Advertising Companies may combine non-personal information they receive from us with personally-identifiable information that they may have already received or may in the future receive from other sources.

C.    With Other Service Providers

To help administer the Services, we may use third-party service providers, such as data analytics services.  Service providers include Madefire.  These service providers will have access to your information only to perform the services they have been engaged to perform for us, and they have agreed not to use it for any other purpose.  They have also agreed not to disclose such information to third parties except under limited circumstances.

As with Advertising Companies, please note that data analytics providers may combine non-personal information they receive from us with personally-identifiable information that they may have already received or may in the future receive from other sources.

D.    Under Special Circumstances

We may disclose information about you to law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), to protect the property and rights of KAM or a third party, to protect the safety of any person or to prevent or stop activity we may consider to be illegal or unethical.
In connection with a merger, acquisition, reorganization or sale of assets, or in the event of bankruptcy, we may sell, transfer or otherwise share some or all of KAM assets, including your personal information.  

E.    Promotions

We may share your personal information in connection with any Promotion you may enter, as necessary to administer, market, sponsor or provide fulfillment under the Promotion or as required by applicable law.  This may include providing winner lists to other parties.

V.    CHILDREN’S PRIVACY

The Services are not intended for children under the age of 13.  We do not knowingly collect any personal information from children under the age of 13.

If we learn that we have inadvertently obtained personal information from a child under the age of 13, we will take reasonable measures to erase the information from our records.  Parents or guardians who believe that KAM might have received any information from or about a child under 13 may submit a request to us at kam@nullkamsf.com and request that the information be removed.

We encourage you to talk with your children about communicating with strangers and disclosing personal information online.

VI.      HOW WE PROTECT YOUR INFORMATION
KAM is committed to protecting the security of your information.  We have implemented security measures to protect against identity theft and unauthorized access.

We do not and will not, at any time, request your credit card information, your login information or other identification in a non-secure or unsolicited communication (such as e-mail).  

Should any breach of security occur, we will make any legally required disclosure to you by e-mail or posting on the Services as soon as reasonably possible, subject to (i) the requests of law enforcement and (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

VII.    HOW YOU MAY CHANGE OR REMOVE INFORMATION

You may email us at kam@nullkamsf.com to request that we delete your personal information from our database.  In that case, please place “delete my account” in the subject line and include your first and last name and e-mail address in the body of the message.  We will use commercially reasonable efforts to honor your request.  We may retain an archived copy of your records as required by law or for business administrative purposes.

Please note that communications you may send through the Services, as well as any comments you may post (and any content from those comments that have been incorporated in other users’ postings or submissions), will be stored by KAM, and will not be deleted unless we determine to do so in our sole discretion.

VIII.    LINKS TO THIRD-PARTY WEBSITES AND SERVICES

The Services may contain links to other websites and online services, including to websites from which you may purchase KAM publications (such as Amazon, Apple iBooks, Google Books and others) and to third-party advertisements.  If you choose to click through to one of these other websites or online services, please note that any information you may provide will be subject to the privacy policy and other terms and conditions of that websites or service, and not to this Privacy Policy.  We do not control third-party websites or services, and fact that a link to such a website or service appears in the Services does not mean that we endorse them or have approved their policies or practices relating to user information.

Before providing any information to any third-party website or service, we encourage you to review the privacy policy and other terms and conditions of that website or service.  You agree that KAM will have no liability for any matters relating to a third-party website or service that you provide information to, including their collection and handling of that information.

IX.    UPDATES TO THIS PRIVACY POLICY

We reserve the right to update this Privacy Policy at any time.  If we modify this Privacy Policy in a material way, a notice will be posted on the Sites along with the updated Privacy Policy for 30 days.  We will also update the “Last Updated Date” in the Privacy Policy.  “Privacy Policy” as used herein includes any updates and modifications we may make from time to time.

By continuing to access or use the Services after we have posted an updated Privacy Policy or have provided you with notice of a modification, you agree to be bound by the modified Privacy Policy.  If the modified Privacy Policy is not acceptable to you, you must immediately stop using any Services.  

X.    NON-US USERS

Information that you provide may be transferred or accessed by entities around the world as described in this Privacy Policy.  If you are located outside the United States, you understand that we may transfer personal information to and process it in the United States.  Privacy and data protection laws of the United States may not be as comprehensive as those of your country.  If you are located in Switzerland or the European Economic Area (EEA), you freely consent to the transfer of personal information outside of Switzerland and the European Economic Area.  Your consent to this Privacy Policy followed by your submission of personal information represents your agreement to these transfers.  

XI.    YOUR CALIFORNIA PRIVACY RIGHTS

If you are a California resident and KAM user, you are entitled to request certain information regarding our disclosure of certain “personal information” (as defined in California Civil Code Section 1798.83) to third parties for their direct marketing purposes.  If you are a California resident and have provided KAM with personal information within the last year, you may make such a request by emailing us at kam@nullkamsf.com and typing the following in the subject line of the e-mail: “California Privacy Rights”.  

Within 30 days of receiving such a request, we will provide a list of the categories of personal information disclosed to third parties for such third parties’ direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties.  A request may be made no more than once per calendar year and we are not required to respond to requests made by means other than through the e-mail address above.  

XII.    DO NOT TRACK DISCLOSURE

KAM does not respond to “Do Not Track” browser signals or other mechanisms.  Third parties may collect personal information about your online activities over time and across sites when you use the Apps.

XIII.    DISPUTES; BINDING ARBITRATION

Any disputes relating to or arising from this Privacy Policy and our obligations and performance under this Privacy Policy will be subject to binding arbitration as provided in our Terms of Use.  PLEASE SEE THE TERMS OF USE FOR IMPORTANT INFORMATION ABOUT THIS PROCESS AND HOW IT AFFECTS YOUR RIGHTS.
